What to Do When Your Wisconsin Client is Moving to a Separate Property State

Randy will review strategies to preserve the income tax benefit of the full basis adjustment of marital property at death, even after clients move from Wisconsin.  He will provide guidance to minimize issues with the Wisconsin Department of Revenue and suggest techniques to avoid probate and ancillary administration.

Randy is a shareholder with von Briesen & Roper, s.c.  His practice focuses on estate planning, family business planning, advising service corporations and partnerships, tax planning, trust administration and probate. He is a Certified Public Accountant and an adjunct professor at Marquette University Law School, where he has been teaching estate planning for over 25 years. He is a frequent speaker at continuing education courses for lawyers and CPAs on the subjects of estate planning and tax planning. He is the author of the chapter “Estate Planning for Owners of Closely Held Businesses” in Eckhardt’s Workbook for Wisconsin Estate Planners published by the State Bar of Wisconsin.

Randy was a member of the State Bar of Wisconsin/Wisconsin Bankers Association (SBW/WBA) Drafting Committee responsible for the Wisconsin Trust Code, which was passed in 2013, and chaired the SBW/WBA Drafting Committee responsible for the Wisconsin Uniform Principal and Income Act, which was passed in 2005. He is currently a member of the SBW/WBA Drafting Committee which is working on the Wisconsin Uniform Power of Appointment Act.

Randy is a Fellow of the American College of Trust and Estate Counsel (ACTEC) and a member of the ACTEC Business Planning Committee. He is a member of the Milwaukee Estate Planning Forum and the Wisconsin and American Institutes of Certified Public Accountants. He holds the Accredited Estate Planner® designation from the National Association of Estate Planners & Councils.

Randy was named the Best Lawyers® Trusts and Estates "Lawyer of the Year" in Milwaukee (2013) and he is listed in The Best Lawyers in America© in Trusts and Estates Law (1995-2022).
